1. Acceptance
By creating an account, connecting a store, or otherwise using TrendSense ("the Service"), you agree to these Terms. If you are using TrendSense on behalf of an organisation, you represent that you have the authority to bind that organisation.
2. The Service
TrendSense provides demand forecasting, trend intelligence, and buyer-brief generation for Indian D2C fashion brands. The Service is delivered via a web dashboard backed by serverless functions and third-party AI providers. Our subprocessor list is published on the privacy policy and updated when it changes. Specific features available on your plan are described on the pricing page in effect when you subscribed.
3. Accounts
You must provide accurate registration information and keep it current. You are responsible for safeguarding your credentials and for all activity under your account. Notify us at security@trendsense.in if you suspect unauthorised use.
4. Subscriptions, billing & refunds
Prices are in Indian Rupees and exclusive of GST unless stated. Subscriptions auto-renew until cancelled. You can cancel from Settings; access continues until the end of the paid period. We do not pro-rate refunds for unused time. We do honour refunds in three scenarios: (a) within 14 days of first payment, (b) when we materially fail to deliver a feature on your plan, (c) where local law (e.g., the Consumer Protection Act 2019) requires.
5. Connected services
TrendSense pulls data from Shopify (when you connect your store), a third-party search aggregator, Google Trends, the publicly-exposed product feeds of competitor Shopify stores, and fashion media. You authorise these reads and warrant that the credentials you supply give us legitimate access. We are not responsible for outages, rate limits, or behavioural changes upstream — though we will work with you to mitigate impact.
6. AI-generated content
Buyer briefs, narratives, vision-tagging, sustainability scoring, and forecast model outputs are generated by AI and statistical models. These outputs are informational, not prescriptive. You retain commercial judgement on every buying decision. We make no warranty that any forecast will materialise or that any brief will produce a specific business outcome. Specifically: the sustainability scoring is an open-mirror of Higg MSI normalised from public LCAs — it is not licensed Higg data and must not be used for verified ESG reporting.
7. Acceptable use
You will not: (a) reverse-engineer, scrape, or otherwise reproduce the Service except as expressly permitted; (b) use the Service to send unlawful, infringing, or harassing content; (c) attempt to access another user's data; (d) introduce malicious code; (e) interfere with our infrastructure or AI subprocessors' acceptable-use policies. We may suspend accounts that violate these rules.
8. Data ownership
Your store data, your account data, and any derivative dashboard insights remain yours. You grant TrendSense a non-exclusive, worldwide licence to host, process, and display them for the sole purpose of operating the Service. If you opt into the data-sharing programme, aggregated, anonymised metrics derived from your store may be combined with other opt-in merchants. We never share raw rows or identifying detail.
9. Intellectual property
TrendSense's software, taxonomy, prompt engineering, training datasets, and curated indices are our intellectual property. Your right to use the Service does not transfer ownership. Feedback you provide may be used to improve the Service without obligation.
10. Confidentiality
Each party will protect the other's confidential information (including your store data and our internal product roadmap) with at least the same care it uses for its own. We will not disclose your confidential information except to operate the Service or where legally compelled.
11. Termination
You can cancel anytime. We can suspend or terminate for material breach with reasonable notice (or immediately for serious harm, including fraud or security risk). On termination we will (a) stop new charges, (b) export your data on request within 30 days, (c) delete your data within 60 days except where retention is legally required.
12. Warranty disclaimer
The Service is provided "as is". We disclaim implied warranties of merchantability and fitness for a particular purpose to the extent permitted by Indian law. We do not warrant uninterrupted or error-free operation.
13. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, or consequential damages. Each party's aggregate liability for direct damages will not exceed the fees paid by you in the 12 months preceding the claim. Nothing in these Terms limits liability for fraud, gross negligence, wilful misconduct, or any liability that cannot be limited by law.
14. Governing law
These Terms are governed by the laws of India. Courts in Bengaluru, Karnataka have exclusive jurisdiction, except where mandatory local consumer law in your jurisdiction requires otherwise.
15. Changes
We may update these Terms. Material changes will be communicated in-app and via the email on file at least 30 days before they take effect. Continued use after the effective date is acceptance.
